Our products are NOT for human consumption, veterinary use, or any clinical or therapeutic application. By purchasing from us, you confirm that you understand and accept this condition. Any use of our products is entirely at your own risk.

1. Acceptance of Terms

By placing an order through our website, you confirm that:

  • You have read, understood, and agree to these Terms and Conditions in full.
  • You are legally capable of entering into a binding agreement.
  • You will comply with all applicable laws and regulations in your jurisdiction regarding the purchase and use of research peptides and related products.

We reserve the right to refuse service to anyone for any reason at any time.

2. Eligibility

You must be at least 18 years of age to use our website and make purchases. By placing an order, you represent and warrant that you are at least 18 years old. We reserve the right to request proof of age or identity at any time and to cancel any order where we reasonably believe the purchaser is under 18 years of age.

3. Research Use Only — Conditions of Sale

All products sold by Kiwi Biolab are sold strictly for in-vitro research, educational, and laboratory purposes only.

Our products are NOT intended for, and must NOT be used for:

4. Limitation of Liability — Disclaimer

Kiwi Biolab accepts no liability whatsoever for the misuse of any products purchased from our store.

Once a product has been dispatched and delivered, the customer assumes full and sole responsibility for its storage, handling, and use. We shall not be held liable for any loss, damage, injury, illness, or any other consequence arising from the use or misuse of our products, whether directly or indirectly.

By completing a purchase, you agree that:

  • You assume all risk associated with the possession and use of the products.
  • Kiwi Biolab bears no responsibility for how products are used after delivery.
  • You will indemnify and hold harmless Kiwi Biolab, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use or misuse of our products.
  • Our total liability in any circumstance shall not exceed the purchase price of the products in question.

Our products are provided “as is” for research purposes. While we strive to ensure the highest quality and purity, we make no warranties or representations regarding fitness for any particular purpose beyond laboratory research.

5. Product Descriptions and Accuracy

We make every effort to display and describe our products as accurately as possible on our website. However, we do not warrant that product descriptions, images, pricing, or other content on the website are complete, accurate, reliable, current, or error-free.

Product specifications, including purity levels and quantities, are provided based on our testing at the time of manufacture. Minor variations may occur between batches. If a product you receive is materially different from its description, please contact us and we will work with you to resolve the issue.

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

6. Pricing and Payment

All prices on our website are displayed in New Zealand Dollars (NZD) unless otherwise indicated. Prices are inclusive of GST where applicable.

We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you place the order.

Payment must be made in full at the time of purchase. We accept the payment methods displayed at checkout. All payments are processed securely through our third-party payment gateway. We do not store full credit card details on our servers.

We reserve the right to refuse or cancel any order if we suspect fraudulent activity, if there is a pricing error, or for any other reason at our sole discretion. If your order is cancelled after payment has been taken, we will issue a full refund.

7. Shipping and Delivery

We ship to addresses within New Zealand only. Delivery timeframes are estimates only and are not guaranteed. Kiwi Biolab is not liable for delays caused by shipping carriers or events outside our control.

It is the customer’s responsibility to provide a correct and complete shipping address. We are not responsible for orders that are undeliverable due to incorrect address information provided by the customer.

Risk of loss and title for all products pass to you upon our delivery of the products to the shipping carrier.

8. Returns, Refunds, and Seized Mail Policy

General Returns

Due to the nature of our products (research chemicals and peptides), we are unable to accept returns of opened or used products. If you receive a product that is damaged, defective, or materially different from what was described, please contact us within 7 days of receiving your order with photographs and details of the issue. We will assess the claim and, at our discretion, offer a replacement or refund.

Refund requests for reasons other than damaged or defective goods are assessed on a case-by-case basis and are at our sole discretion.

Seized Mail Refund Policy

In the event that an order is seized, confiscated, or destroyed by any government agency or authority during transit, Kiwi Biolab will offer a maximum refund of 30% of the order value only. This partial refund is offered as a goodwill gesture and is not an admission of liability. We are not liable for the seizure of shipments. By placing an order, you acknowledge and accept this policy.

To request a seized mail refund, you must provide official documentation (such as a seizure notice from customs or a government agency) as proof. Claims must be submitted within 30 days of the estimated delivery date.

Refund Processing

Approved refunds will be processed using the original payment method within 10 business days of approval. Shipping costs are non-refundable unless the error was on our part.

9. Order Cancellation

We offer a 24-hour grace period after an order is placed during which you may cancel your order for a full refund. To cancel, contact us within 24 hours of placing your order.

After the 24-hour grace period has passed, orders cannot be cancelled. If your order has already been dispatched, no cancellation is possible and the returns policy above applies.

We reserve the right to cancel any order for any reason, including but not limited to suspected fraud, suspected non-research use, product unavailability, or pricing errors. If we cancel your order, you will receive a full refund.

10. Account Responsibilities

If you create an account on our website, you are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorised access or use of your account.

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms or if your account has been compromised.

11. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, product descriptions, page layouts, and software, is the property of Kiwi Biolab or its content suppliers and is protected by New Zealand and international intellectual property laws.

You may not reproduce, distribute, modify, display, create derivative works from, or exploit any content from our website without our prior written permission. Unauthorised use of our intellectual property may result in legal action.

12. Prohibited Conduct

16. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

The provisions of the Consumer Guarantees Act 1993 apply to goods and services supplied to consumers in New Zealand, except to the extent that our products are acquired for the purposes of a business, in which case those guarantees are excluded to the fullest extent permitted by law.
